Overview
Fraud remains a constant threat to the assets and reputation of modern businesses. The effects of fraud are often dramatic and far reaching. To
minimise the effects, swift action is required to prevent the further loss of value and to recover assets before they dissipate beyond reach. Our speakers on this topic, Lewis Man and Nick Gall, partners at the law firm Gall & Lane, will share
their practical and common sense knowledge and experience derived from advising both victims and investigators of fraud. This presentation will touch upon: Considerations for any business implementing a fraud deterrence program;
Red flag indicators of fraud; “War stories” and real-life case studies where businesses have been defrauded by third parties or their own employees; and How lawyers can assist businesses that are the
victims of fraud.
Lewis Man
Lewis has over 10 years′ post-qualification experience in conducting general commercial litigation work with a particular emphasis on contentious insolvency, cross-border litigation and fraud
investigations.
Recent work includes acting for a group of companies in related large-scale cross-border actions worth in excess of HK$1 billion involving allegations of fraud and breach of directors′ fiduciary duties; acting for the liquidators
of a collapsed worldwide group of companies operating a Ponzi scheme from the Philippines; acting for investors defrauded by the operators of a boiler room in the United States; acting for a group of Indonesian investors defrauded by a Singaporean fund;
acting for noteholders, whose investment in a PRC project was misappropriated by the notes issuer; acting for the liquidator of a worldwide group of companies, whose entire business undertaking was misappropriated by newly formed corporate entities.
Lewis has also advised on matters relating to RBG Resources and Shanghai Merchants concerning Ponzi schemes and fictitious trades. Lewis has also advised the underwriters of the Hong Kong Stockbrokers′ Fidelity Insurance Scheme on numerous cases
involving the unauthorised trading activities and defalcations of stockbrokers discovered after the stock market collapse in the late 1990′s.
He is a member of the Association of Certified Fraud Examiners and is a contributing author
to The 2009 Fraudnet World Compendium on Asset Tracing & Recovery.
Nick Gall
Nick′s principle areas are commercial litigation, employment, fraud/assets tracing and insolvency.
He has acted for publicly listed companies,
senior employees, the Hong Kong Government, the US Government, major international banks and corporations throughout Asia.
Nick′s work often requires document intensive cross-border applications, freezing/gagging applications, urgent
injunctive relief, the examination of senior executives/bank officers and recovery and enforcement proceedings generally. He also has extensive experience in forcing banks and financial institutions to provide information to assist in tracing and recovery
of funds and fending off vulture funds in respect of international sovereign debt recoveries.
In 2009, Nick was named as one of the Hot 100 Lawyers in Asia, by Asian Legal Business, the leading
Asian journal aimed at the legal profession. The Hot 100 is an annual list of the top one hundred lawyers in Asia who have performed exceptionally in their fields.
